The Labour Market Services and Benefits Act lays down a number of cases in which a person cannot register as unemployed.

You cannot register as unemployed if you:

  • are under 16 years of age;
  • are of retirement age or receive an early retirement pension;
  • are working based on a contract of employment, contract for services, authorisation agreement or contract under the law of obligations for provision of other services, or are in public service;
  • are a member of the management board of a company, a procurator, a partner authorised to represent a general or limited partnership, the director of a branch of a foreign company or manager of another permanent establishment of a non-resident;
  • are a member of the management or controlling body of a legal person specified in § 9 of the Income Tax Act (which is not specified in the previous paragraph) and receive remuneration for such work;
  • are registered as a sole proprietor;
  • are in the register of taxable persons as a spouse participating in the activity of a sole proprietor's enterprise;
  • are a student enrolled in daytime study or full-time study at an educational institution (unless you are enrolled in full-time study or in daytime vocational training and have worked for at least 180 days during the last 12 months or are on academic leave);
  • are in conscript, alternative or reserve service;
  • receive a spouse allowance on the basis of the Foreign Service Act or the Civil Service Act;
  • receive the allowance of a rescue worker awaiting the old-age pension on the basis of the Rescue Service Act;
  • are not a citizen permanently residing in Estonia or a foreigner residing in Estonia on the basis of a temporary residence permit; are not a citizen of the European Union or Switzerland, Iceland, Liechtenstein or Norway or an asylum seeker from these countries; are not receiving temporary/subsidiary international protection or applying for asylum;
  • are a member of the Riigikogu, a member of the European Parliament, a member of the Government of the Republic, the President of the Republic, a judge, the Chancellor of Justice, the Auditor General, a Public Conciliator, the chairman or deputy chairman of a council of a local government working in remunerative positions, a member of a rural municipality or city government working in a remunerative position (including a rural municipality or city mayor), a rural municipality or city district elder;
  • are engaged in a profession in public law as an independent person;
  • terminated your status as unemployed less than 90 days ago and your last two consecutive registrations as unemployed were terminated in the 12 months prior to submitting the application because you:
    • failed, at least on one occasion within a period of 30 days, to appear for a visit without a good reason;
    • failed, without a good reason, to appear for a visit at the prescribed time for the third time;
    • refused to approve the individual action plan;
    • refused to comply with the Individual Action Plan for the third time without a good reason;
    • refused to accept suitable work for the third time without a good reason.
